Terms of Service (English)

These Terms of Service ("Terms") govern your use of Artie22("Service"), operated by Ben Aharonson ("we", "us", "our"), Kibbutz Naan, Israel. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years old and agree to comply with these Terms. If you do not agree, you may not use the Service.

2. Service Description

Artie22 is an AI-powered marketing employee for small and founder-led businesses. The Service allows you to:

• Create and manage marketing projects and campaigns
• Generate AI-assisted marketing content, ad creative, and copy
• Connect third-party social, advertising, and messaging accounts (via our processor Zernio) so Artie22 can publish posts, run and manage paid ad campaigns, and read/reply to messages, comments, and reviews on your behalf
• Review, approve, and stage creative and advertising actions before they go live
• Sync leads and contacts into a connected CRM
• Interact with the Service via WhatsApp
• Receive notifications about workflow, campaign, and billing status

3. User Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

4. Connected Accounts and Authorization to Act on Your Behalf

4.1. When you connect a social media, advertising, messaging, or other third-party account to Artie22, you authorize us to access that account and to take the actions you approve or configure — including publishing content, replying to messages, and creating, editing, pausing, or spending against advertising campaigns — strictly within the permissions and limits (including any spend limits) you set.

4.2. You are responsible for ensuring your use of connected accounts complies with each third-party platform's own terms of service. We are not responsible for suspension, restriction, or other action taken by a third-party platform against your account.

4.3. You may disconnect any connected account at any time through Settings. Disconnecting does not reverse actions already taken or already-incurred advertising spend.

4.4. No paid advertising spend is initiated without your explicit approval of the specific campaign and budget, or a spend limit you have configured in advance.

5. Content Ownership

5.1 Your Content

You retain ownership of all content you upload, submit, or create using the Service, including prompts, briefs, images, brand assets, and project data. By using the Service, you grant us a limited license to process your content solely to operate and deliver the Service.

5.2 AI-Generated Content

Content generated by AI through the Service is provided to you for your use. You are responsible for reviewing AI-generated content before approving it for publishing or distribution. We make no guarantees regarding the accuracy, originality, or legal compliance of AI-generated content.

5.3 Third-Party Data

Where the Service surfaces data about people who interact with your business (message senders, commenters, reviewers, leads, or contacts), that data belongs to and is your responsibility as the business relationship holder. You are responsible for having a lawful basis to collect, store, and act on it, and for your own privacy notices to those individuals.

5.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Generate or publish content that is defamatory, obscene, or infringes on third-party rights
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with unauthorized parties
• Use automated scripts or bots to access the Service without permission
• Circumvent usage limits, credit limits, or spend limits

7. AI Disclaimer

The Service uses third-party AI models to generate content. AI-generated outputs may be inaccurate, incomplete, or unsuitable for your intended use. You should always review and approve AI outputs before they are published or acted on. We are not liable for any consequences arising from the use of AI-generated content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

9. Payment, Billing, and Credits

9.1. The Service is offered on paid subscription plans and optional credit top-up packs. Current pricing is shown at checkout. Payments are processed by our payment provider (Paddle.com Market Limited, as merchant of record, or another processor we designate), whose own terms also apply to your purchase.

9.2. Subscriptions renew automatically for successive billing periods unless cancelled before the renewal date. Generation and other paid actions consume credits allocated to your plan or purchased separately; consumed credits are non-refundable.

9.3. Cancellation and refund terms, including the 14-day cancellation right available to Israeli consumers, are set out in our Refunds & Cancellations Policy, which forms part of these Terms.

9.4. We reserve the right to change pricing with reasonable advance notice.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, business opportunities, or advertising spend, except where such spend resulted from our failure to honor a spend limit you configured.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, your connected accounts, or your violation of these Terms.

12. Termination

• You may delete your account at any time through the Settings page.
• We may suspend or terminate your account if you violate these Terms, with notice where reasonably possible.
• Upon termination, your right to use the Service ceases immediately and connected accounts are disconnected. Your data will be handled according to our Privacy Policy.

13. Intellectual Property

The Service, including its design, code, features, and documentation, is our intellectual property. Nothing in these Terms grants you rights to our trademarks, logos, or other brand assets.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of the Tel Aviv district.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
